Apenas dos días antes de su entrada en vigor, un juez federal bloqueó temporalmente gran parte de la ley estatal SB4 de Texas, aunque dejó intacta una sección que habilitaría a los policías y alguaciles en todo el estado a preguntar sobre el estatus migratorio de cualquier persona durante una detención o arresto, incluso una parada de tránsito.

El juez Orlando García decidió este miércoles que algunas partes de la ley no entrarán en vigor el próximo viernes, 1 de septiembre, como se había establecido cuando el congreso estatal aprobó la medida. Su implementación será frenada hasta que el juez decida si esas secciones violan los derechos de los texanos bajo la Constitución.
En general, el fallo prohíbe que se castigue a los líderes de Texas por adoptar políticas santuario, por lo que alcaldes, jefes de policía, alguaciles y universidades podrán seguir limitando su cooperación con agentes de inmigración.
Esto significa que los policías y alguaciles pueden efectivamente prohibir que sus agentes cooperen con el Servicio de Inmigración y Aduanas (ICE) sin ser multados o despedidos. También significa que las cárceles no estarán obligadas a detener inmigrantes cuando ICE se lo pide sin una orden judicial.
